Order Before WEICK, ENGEL and MERRITT, Circuit Judges. Upon consideration of the motion of respondents to dismiss the petition for review as moot, the response thereto, and arguments of counsel, and it appearing to the Court that the Consent Order issued pursuant to Section 113(a) of the Clean Air Act, 42 U.S.C. ร§ 7413(a), to bring the operation of coke oven battery No. 1 into compliance with the Ohio State implementation plan (Sip), expired by its own terms on September 1, 1978; and because of the enactment of the 1977 amendments to the Clean Air Act, there is no need for this Court to determine the propriety of EPA's practice of issuing Section 113(a) orders under the 1970 Clean Air Act, the Court finds that the issues of this proceeding have become moot.
